1. Who we are
Procaffeinated is operated by The Black Circle Group Limited ("we", "us"), a company registered in England and Wales. Procaffeinated® is our registered trademark.
2. Acceptance of these terms
By creating an account, accessing, or continuing to use Procaffeinated, you agree to be bound by these Terms of Use. If you do not agree, you must not use the service.
3. Eligibility
You must be 16 or older to create an account. By signing up you confirm that the information you provide is accurate and that you have the authority to enter into these terms.
4. The service
Procaffeinated is a social caffeine and performance tracker. Some features are free, others are offered as paid subscriptions or one-off purchases. Features may change as we develop the product.
5. Your account
You are responsible for keeping your credentials secure and for all activity on your account. We may suspend or remove accounts that violate these terms.
6. Acceptable use
Don't misuse the service: no unlawful use, fraud, spam, harassment, IP infringement, scraping, malware, probing, or interference with security or availability.
7. Payments, subscriptions and billing
Paid plans are billed in advance on a recurring basis (monthly or annually as selected at checkout) and renew automatically until cancelled. Prices are shown at checkout in the applicable currency and are inclusive of any taxes Paddle is required to collect. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period. Payment, billing, tax, cancellation and refund mechanics are governed by the
Paddle Buyer Terms and our
Refund Policy.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Intellectual property
We retain all right, title and interest in and to the Procaffeinated service, including its software, content, branding and trademarks. You are granted a limited, non-exclusive, non-transferable right to use the service in accordance with these terms and your selected plan.
10. Health disclaimer
Procaffeinated is not a medical device. Caffeine logs and performance metrics are for informational purposes only and are not medical advice. Consult a qualified professional before changing your caffeine intake.
11. User content
You retain ownership of the content you submit. You grant us a worldwide, royalty-free licence to host, store and display it solely to operate and improve the service.
12. Service level
We aim to keep the service available but do not guarantee uninterrupted or error-free performance. We may modify, suspend or discontinue features at any time.
13. Suspension and termination
You may close your account at any time. We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations.
14. Liability
To the fullest extent permitted by law, the service is provided "as is" without warranties. We are not liable for indirect, consequential, or special losses (including loss of profits, data or goodwill). Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
15. Changes
We may update these terms. Material changes will be notified by email or in-app notice.
16. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
